Welcome to the True Trace Metrology web application (the "Platform"). These Terms and Conditions ("Terms") govern your access to and use of the Platform, including any subdomains, user portals, Calibration Laboratory Information Management Systems (LIMS), certificate download links, and any services, functionality, or content offered on or through the Platform.
1.1 Acceptance of Terms
By registering for an account, submitting equipment for calibration, accessing calibration certificates, or otherwise using the Platform, you accept and agree to be bound and abide by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.
1.2 Account Security and Eligibility
To access certain features of the Platform, including scheduling calibrations, reviewing status updates, or downloading calibration certificates, you will be required to create a secure account. You agree that:
- All information you provide to register with this Platform is correct, current, and complete.
- You are responsible for maintaining the strict confidentiality of your account credentials, username, and password.
- You will immediately notify True Trace Metrology of any unauthorized access to or use of your username or password, or any other breach of security.
- You will ensure that you log out from your account at the end of each session, particularly when accessing the Platform from a public or shared computer.
1.3 Authorized Use & Prohibited Conduct
You may use the Platform solely for legitimate commercial calibration business transactions with True Trace Metrology. You explicitly agree not to use the Platform:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- To transmit, or procure the sending of, any advertising or promotional material without our prior written consent.
- To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Platform, or which, as determined by us, may harm True Trace Metrology or users of the Platform.
- To introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Platform, the server on which the Platform is stored, or any server, computer, or database connected to the Platform.
1.4 Intellectual Property Rights
The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by True Trace Metrology, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Notwithstanding the foregoing, finalized Calibration Certificates, measurement data reports, and specific asset histories generated for your specific equipment belong to you upon receipt of full payment.
1.5 Electronic Signatures and Documents
In accordance with the Uniform Electronic Transactions Act (UETA) and the Electronic Signatures in Global and National Commerce Act (E-SIGN), you consent to use electronic signatures and to receive documents electronically through the Platform. You agree that your electronic submission of calibration requests, approval of quotes, and acceptance of decision rules constitute your binding legal assent.
Privacy Policy
True Trace Metrology ("we," "us," or "our") is committed to protecting the privacy and security of your personal and corporate information. This Privacy Policy describes how we collect, use, protect, and disclose information when you utilize our web application, portals, and calibration services.
2.1 Information We Collect
We collect several types of information from and about users of our Platform, including:
- Personal Identifiers: Name, professional title, corporate email address, phone number, billing address, and shipping address.
- Equipment and Technical Data: Tool descriptions, manufacturer metadata, model numbers, serial numbers, instrument ID tags, historical calibration intervals, and technical measurement parameters submitted for calibration profiling.
- Transactional Information: Details about quotes, purchase orders, calibration requests, service history, invoicing records, and payment confirmations.
- Usage Details and Diagnostics: IP addresses, browser types, operating systems, access times, pages viewed, and pathing tracking data collected automatically as you navigate through the Platform.
2.2 How We Use Your Information
We process your data to fulfill our commercial and regulatory obligations, including to:
- Provide, maintain, and optimize the functionality of our LIMS and customer web portal.
- Process, track, and execute calibration service orders, and deliver automated notifications regarding calibration intervals, recalls, or status adjustments.
- Generate, securely store, and render tamper-evident electronic Calibration Certificates.
- Ensure compliance with ISO/IEC 17025:2017 requirements concerning customer data maintenance, traceability tracking, and record retention.
- Administer billing, process invoices, and handle logistical routing for equipment delivery and pickup.
2.3 Data Security and Encryption
We implement robust technical and organizational measures designed to secure your personal and technical data from accidental loss and unauthorized access, alteration, or disclosure. All communication between your browser and the Platform is encrypted using industry-standard Transport Layer Security (TLS/HTTPS). Secure data store environments are protected behind advanced firewalls and access controls. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
2.4 Data Sharing and Third-Party Disclosures
We do not sell, rent, or trade your personal or technical data to third parties for marketing purposes. We only share information with:
- Approved logistics and shipping carriers (e.g., UPS, FedEx) to facilitate the safe transit of your physical instrumentation.
- External assessment and accreditation bodies (e.g., ANAB, A2LA, NVLAP) solely when strictly required during official laboratory technical competence audits.
- Legal entities or law enforcement if required to comply with a valid subpoena, judicial order, or statutory requirement.
ISO/IEC 17025 Specific Service Disclaimer
The provisions within this section form an essential framework for all engineering, calibration, metrology, and testing services rendered by True Trace Metrology through the web application or within our physical laboratory facility located at 6841 N Rochester Rd, Rochester Hills, MI 48306.
4.1 Technical Competence and Metrological Traceability
True Trace Metrology performs calibrations utilizing reference standards whose accuracies are traceably linked to the International System of Units (SI) through the National Institute of Standards and Technology (NIST) or other recognized national metrology institutes (NMIs). Calibrations are executed in strict alignment with formal documented procedures, validated laboratory methods, and the overarching parameters of the ISO/IEC 17025:2017 standard.
4.2 Specific Calibration Limitations
The client explicitly acknowledges and accepts the following metrological realities:
- Temporal Validity: A Calibration Certificate provides data regarding the specific instrument's measurement responses exclusively at the precise time, date, and environmental conditions under which the calibration was performed. True Trace Metrology offers no prospective warranties regarding the instrument's ongoing drift, stability, or physical performance over time once it has left our controlled laboratory environment.
- Decision Rules and Statement of Conformity: Unless an explicit alternative decision rule is formally designated by the customer via the web application's submission portal, True Trace Metrology applies a standard binary shared-risk decision rule for all statements of conformity. In a shared-risk model, the donor assumes the risk that an instrument evaluated as "In Tolerance" may technically fall outside the tolerance bounds due to the inherent expanded measurement uncertainty budget.
- Customer-Provided Metadata: The customer is solely responsible for entering accurate instrument identifiers, tolerances, manufacturer specifications, and custom calibration point profiles into the Platform. True Trace Metrology accepts no liability for certificates rendered invalid, legally deficient, or technically flawed due to erroneous customer data entry.
4.3 Confidentiality and Impartiality
Per ISO/IEC 17025:2017 Clause 4.1 and Clause 4.2, True Trace Metrology maintains absolute structural impartiality and safeguards the strict operational confidentiality of all customer technical data, proprietary manufacturing specifications, and calibration outcomes. Except for information that the customer makes publicly available, or when explicitly ordered by an accreditation body or statutory law enforcement agency, all information is considered proprietary and treated as highly confidential.
4.4 STRICT LIMITATION OF LIABILITY
IN NO EVENT SHALL TRUE TRACE METROLOGY, ITS DIRECTORS, EMPLOYEES, TECHNICIANS, OR AGENTS BE LIABLE TO THE CLIENT OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER. THIS INCLUDES, BUT IS NOT LIMITED TO, LOSS OF PROFITS, LOSS OF PRODUCTION, MANUFACTURING DOWNTIME, PRODUCT RECALLS, REGULATORY FINES, BREACH OF CONTRACT COSTS, OR PROPERTY DAMAGE RISING OUT OF OR RELATING TO THE USE OF THE WEB APPLICATION, THE RELIANCE UPON CALIBRATION CERTIFICATES, OR THE PHYSICAL PERFORMANCE, MISCALIBRATION, OR FAILURE OF ANY INSTRUMENT CALIBRATED BY THE LABORATORY.
THE MAXIMUM AGGREGATE LIABILITY OF TRUE TRACE METROLOGY ARISING OUT OF OR IN CONNECTION WITH ANY CALIBRATION SERVICE, REGARDLESS OF THE LEGAL THEORY ADVANCED (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), SHALL BE STRICTLY LIMITED TO THE ACTUAL NET FEE PAID BY THE CLIENT TO TRUE TRACE METROLOGY SPECIFICALLY FOR THE INDIVIDUAL CALIBRATION EVENT OF THE INDIVIDUAL TOOL OR INSTRUMENT GIVING RISE TO THE CLAIM.
4.5 Indemnification
You agree to defend, indemnify, and hold harmless True Trace Metrology, its licensors, service providers, officers, directors, employees, and accredited technicians from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these web platform policies, your misuse of generated calibration data, or the deployment of physical instruments in critical, high-risk, aerospace, medical, or automotive manufacturing environments where failure could induce injury or systemic supply chain damage.
4.6 Governing Law and Jurisdiction
All matters relating to the Platform, these documents, and any dispute or claim arising therefrom or related thereto shall be governed by and construed in accordance with the internal laws of the State of Michigan, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these terms or services shall be instituted exclusively in the federal or state courts located in Oakland County, Michigan, United States.
